Observers—two groups of about 18 each. One group of students from San Francisco were with a Tucson Sam. The other group of looked older but came late and left before I did.
75 migrants including 7 women. 15 were charged only with illegal entry and 60 were charged with illegal entry and reentry. This judge does not mention country of origin but 20 people were picked up near Nogales including 2 at the Port of Entry, 20 near Sasabe, 19 near Lukeville, 8 near Douglas and 2 near Naco.
The defendants were seen in 11 groups. The first group had 5 people dismissed, mostly for language and one, Antonio Gonzalez Vasquez 28732M (lawyer Lerch), was continued until November 1 to find an interpreter (Zapoteco Alto?).
All the 1325s were given ‘Time Served’. One, Adrian Castro Romero 28693MP, was picked up at the Nogales Port of Entry with false documents.
Jaime Bernal Canseco 28661M was picked up trying to evade notice at the Nogales Port of Entry—30 days.
Carlos Sainz Aguirre 28666M (lawyer Valdez) is an English speaker who grew up in Phoenix. He did not speak any Spanish during the proceedings—105 days.
Alberto Bruno Pioquinto 28680M (lawyer Washington) and Maria De Lourdes Cervantes Martinez 28668M (lawyer Solares) are husband and wife both given 30 days at the same facility.
Roberto Ramirez Arenas 28722M (lawyer Valadez) had his right arm in a sling. His lawyer told the judge that he asked his client if he had been injured by the BP but Mr. Ramirez said he had done this before he was apprehended.
No asylum requests or credible fear.
55 people were sentenced to 3,510 days of incarceration or about 9 and one half years. This was a low amount for this number of migrants; 25 people were given 30 days and only 3 had 180. The cost of incarceration, mostly in private prisons, is $565,110 for one day of OS in Tucson Arizona representing one sector out of nine border sectors.
Several people had an indigenous language that their lawyers put in the record. Several had incarceration requests which the judge honored.
Quite a few people were confused but not to the extent this judge experienced his last time doing OS.
