Judge D. Thomas Ferraro, 14 lawyers, Federal lawyer (not the usual)
75 defendants, including 2 women.
40 had only the misdemeanor charge (1325) and 35 were also charged with reentry (1326).
Of the places of entry mentioned 22 were picked up near Nogales including 2 at the port of entry, 21 near Sasabe, 9 near Douglas including one at the port of entry, and 8 each near Naco and Lukeville. 62 people were from Mexico, 6 from Guatemala and 2 from Honduras (in a few cases no country of origin was mentioned). 8 people were picked up about 5 days after the date they gave as the date they had entered the country; most entered and were picked up in the past couple of days.
The defendants were seen in 11 groups. Of the first group of 4, 3 were dismissed—language?—and one, Jesus Adam Bejarano Castro 29261M (lawyer Myrla Garcia) was continued until November 6th.
The 40 1325s were all given ‘time served’. Two of them, Gonzalo Vazquez De Jesus 29288MP (lawyer Beards) and Hector Javier Rocha Segoviano 29329MP (lawyer McGuire) were picked up at a port of entry.
Grace Goodman, the lawyer of Guatemalan Juan José Garcia 29268M, put his request for credible fear in the record. This was at the end of his group and if there was more discussion, I didn’t hear it.
Cesar Guerrero Muratalla 29289M (lawyer Garcia) was held over without bail at the request of the federal lawyer.
Jesus Payan 29302M (lawyer Bacal) is an English speaker who grew up in Phoenix. His family has some ongoing immigration proceedings there. His lawyer says he did something ‘really stupid’ and was arrested—75 days.
32 of the 1325-1326 group were sentenced to 2655 days or over 7 years of incarceration—mostly in private prisons—at a cost of $427,455. What could we do with all that gold?
The prisoners, now that they are unshackled, are instructed to keep their hands clasped behind their backs and this week that is what most did. Last week with Judge Markovich it was the opposite with most people letting their arms rest at their sides or in front. What’s that about?
