Magistrate Judge Lynnette C. Kimmins, Federal Prosecutor Christopher Lewis, 17 Attorneys, 1:30-4:15
Observers: 4 members of the family of Ismael Suarez Chavez 18-25223M (Attny Richard Bacal) who entered the U.S. at Douglas in September of 2013 and was picked up by BP (?) in Tucson on 4/11 2018.
Also present, Lois M. (No More Deaths) with a group of four and a GV Sam.
There were 75 migrants on the docket today including 9 women. 26 were charged with only illegal entry—1325--and 49 people had the additional charge of illegal reentry—1326.
This judge does not give the country of origin. 21 migrants were arrested near Douglas, 16 near Nogales, 13 each near Naco and Sasabe, 7 near Lukeville and 6 were given as Southern Arizona. 3 people were arrested for attempted illegal entry. Most migrants were picked up within a few days of the date they gave for an entry date except Mr. Suarez Chavez mentioned above. 7 migrants had 4-5 days before being picked up and one had 10 days.
Several lawyers put a primary language other than Spanish on the record but said their clients seemed to understand Spanish well. Judge Kimmins questioned these migrants to assess comprehension and had a couple sit back down for further discussion with their lawyers. In addition to language concerns, the way in which this judge asked her questions seemed to be confusing to some.
There were no asylum or credible fear requests for the 1325 group.
Atty Rodolfo Valenzuela for Nancy Guerra Guerra 18-25221MP put on the record that her client had had 1,400 pesos ($77) taken from her purse in Douglas by an agent where she was apprehended and not returned when the purse was returned.
There were two requests for asylum/credible fear in the 1325/1326 group
Sergio Icedo Medrano 18-25237M (Atty Micaela Portillo) was arrested for attempted illegal entry in Douglas. He is from Agua Prieta and his son had recently been killed there. He fears he will be killed if he returns. Ms. Portillo gave him a petition which he carried from the courtroom. 105 days.
Fernando Calderon Vazquez 18-25258M (Atty Guenevere Nelson-Melby) requested a credible fear interview. 180 days.
Mataeo Rocha Rodriguez (Atty Myrna Beards) is an older man (50s?) with a young family of 4 girls, one of whom is very ill. He is here because of the care she needs. He did not use earphones and answered in English—135 days.
Ismael Suarez Chavez 18-25223M (Atty Richard Bacal) entered the U.S. in September of 2013 and was picked up in Tucson April 11. Four members of his family were in court. 135 days.
47 migrants charged with 1325-1326 were sentenced to 2,970 days or about 8 years of incarceration at the cost to taxpayers—including some of these migrants—of $478,170.
And then there’s the court costs.
