Each judge has handled the resuming of shackling in a different way. Judge Ferraro started with all 47 of those charged with the misdemeanor of Illegal Entry (1325) seated in the courtroom with 5-point shackles. He described the charges, rights and consequences to the whole group then he called one page of the calendar at a time—sometimes 8, sometimes 7—until he finished with that group. The plea bargain group was only 28 and were also seated in the courtroom together for the explanation and called up according to the calendar. This group took about 20 minutes.
There were 75 migrants today including 8 women. 3 were dismissed at the start of the proceedings with no explanation. Of the countries of origin given 56 people were from Mexico, 7 from Guatemala, 2 from El Salvador and 1 from Honduras. The gentleman who works with the Guatemalan Consulate told me there were about a dozen from Guatemala so I suppose the dismissed might have been from there.
29 people were arrested near Nogales, 16 near Sasabe, 7 near Douglas, 5 near Lukeville, 4 near Naco, 2 near Sonoita, and one each near Sierra Vista and San Miguel. A few people had spent 5 days from entry until arrest but most were arrested within a day or two of arrival and three were attempted entries at Nogales.
28 migrants in the plea bargain group were sentenced to 1,200 days of incarceration (17X30, 9X60, 2X75). More people with multiple re-entries are being sent to felony court.
There were no credible fear or asylum requests. Carlos Adolfo Garcia Solis 1834916MP had his arm in a sling—no explanation.
Judge Ferraro was very distracted at times. He missed all of page three after the two general questions and did not say—‘Is it true that you are from Mexico and on October __ entered the United States near _____’ to anyone on that page. I later asked a lawyer about it and he said it probably wouldn’t matter as this was part of the 1325 group and would only get ‘time served’. He started to miss two more pages but was caught by Mr. Lewis and one of the lawyers.
